Our practice in North America has been strong in the US and Canada for well over five decades. (As shown on our Latin America practice description, we also have a strong practice in Mexico.) Serving a broad array of clients from virtually every key public and private industry sector in North America, our attorneys provide cutting-edge transactional, regulatory, and litigation services designed for clients who seek high-quality legal counsel with a keen eye on industry-specific business strategy. We represent US- and Canadian-based enterprises, organizations, and individuals both at home and abroad, as well as global clients who wish to leverage our experience in the US regulatory, transactional, and litigation arenas to conduct business in the US and Canada.
In the transactional area, our clients range from large multinational corporations and financial institutions to start-up technology and e-commerce companies. Firmwide, attorneys in our corporate group handle sophisticated transactions, including mergers and acquisitions, capital markets financing, and private equity transactions. Our litigation practice is equally extensive. We are actively engaged in litigation in the US federal and state courts, as well as in both national and international arbitration organizations. In addition to serving in all traditional litigation roles—from pretrial discovery to trials to appellate advocacy—the firm frequently serves as "national coordinating counsel" for its clients, defending related cases across the US through networks of local counsel. In addition, we maintain our rich heritage of regulatory excellence, offering clients distinct access to US government and regulatory bodies, ensuring that clients achieve strategic business objectives within the context of stringent and ever-evolving government and regulatory frameworks.
Attorneys throughout our offices work with Canadian companies engaged in transactional, litigation, and regulatory matters in the US and other countries, including Canadian corporations, trade associations, and governments. We represent both large bank-owned dealers and independent Canadian securities dealers—who account for a very large proportion of the capital in play in the Canadian securities industry. We also serve as counsel to various trade and self-regulatory organizations in efforts to reduce barriers to cross-border trading in securities. Internationally, Arnold & Porter LLP has advised Canadian entities in regard to major US antidumping and countervailing duty cases, including cases on imports into the US of lumber, wheat, cattle, and pork products. These cases have included representation in dispute settlement proceedings before bi-national panels under the North American Free Trade Agreement (NAFTA) and related proceedings in the World Trade Organization. We also advise companies on various NAFTA and customs compliance matters, including rules of origin, and we have represented companies in NAFTA audits. In addition, we represent Canadian issuers in many different types of cross-border financing and M&A transactions.
