Arnold & Porter successfully defeated a motion for class certification in a case filed against our client, Honeywell. Plaintiffs alleged that they and other construction workers at a former Honeywell site were exposed to toxic chemicals and were entitled to medical monitoring. The court refused to certify the class of hundreds of construction workers because plaintiffs failed to present sufficient evidence that common issues would predominate in the case.
