Our government contracts team regularly counsels clients on virtually all aspects of export control and trade regulation matters, including those related to the Export Administration Regulations (EAR) administered by the Department of Commerce, the International Traffic in Arms Regulations (ITAR) administered by the Department of State, and the national security and foreign policy sanctions laws administered by the Department of the Treasury.  We assist clients seeking modifications of problematic statutory or regulatory standards.

Our attorneys advise US exporters on the full range of international technology transfer issues and compliance and licensing matters relating to controlled technologies.  We assist clients in preparing and obtaining approval for necessary export control agreements, such as manufacturing licensing agreements and technical assistance agreements, and in obtaining new registrations under the ITAR, as well as in obtaining specific licenses to give foreign persons in the US access to ITAR-controlled goods and technical data.  Similarly, under the EAR, we assist a wide range of clients in obtaining the various licenses required to permit particular exports subject to those rules.

To ensure compliance with export control regulations, we regularly counsel clients on controls on business activity, work closely with companies on voluntary disclosures, and help design internal compliance programs to ensure proper licensing of exports and re-exports—programs that prevent, deter, and detect violations of federal, statutory, and regulatory requirements.  We assist in the development and implementation of such compliance programs and draw on the vast experience of our firm in the wide range of industries that we serve.
