Litigation

Robert Weiner is a partner in the firm's Business Litigation practice group. He rejoined Arnold & Porter LLP in 2012, having served as Associate Deputy Attorney General at the United States Department of Justice since 2010. At DOJ, he oversaw the defense of the new healthcare law from the outset of litigation through the arguments at the Supreme Court, handled sensitive negotiations involving bank secrecy, and dealt with difficult issues as they arose in areas ranging from antitrust and financial reform to national security and Congressional investigations.

Mr. Weiner has substantial experience as a trial lawyer and appellate advocate in criminal and civil cases.  His experience includes serving as national coordinating and trial counsel in product liability and toxic tort cases; representing clients in media-intensive Congressional investigations and regulatory inquiries, as well as confidential, criminal, and disciplinary investigations; and representing the State of Israel in litigation involving national security policies.

From 1997-98, Mr. Weiner served as Senior Counsel in the White House Counsel's Office where he dealt with the legal aspects of major legislative and public policy issues confronting the nation including global warming, civil rights, financial reform, and privacy. Mr. Weiner has also taught Mass Torts at the University of Virginia School of Law and Complex Criminal Litigation at the Georgetown University Law Center. In 1987, Mr. Weiner served as an Associate Independent Counsel in the Wedtech prosecution. Mr. Weiner clerked for Judge Henry Friendly of the US Court of Appeals for the Second Circuit and for Supreme Court Justice Thurgood Marshall.

  • Filed amicus briefs for the Product Liability Advisory Council in the US Supreme Court as well as the US Courts of Appeal for the 2d, 3d, 6th, and 8th Circuits, and for the Leadership Conference on Civil Rights, the National Women's Law Center, the National Association of Criminal Defense Lawyers (in the Arthur Andersen case in the US Supreme Court), Former Judges and Justice Department Officials, Police Chiefs, Legal Historians, and the Health Insurance Association in the US Supreme Court.
