Practice Focus

A Manuel García is part of Arnold & Porter LLP's international arbitration group. His practice focuses on international dispute resolution, particularly in the area of international investment and trade with an emphasis in Latin America including, specifically, Argentina, Chile, Ecuador, Guatemala, Mexico and Venezuela as well as an emphasis in the electricity generation and distribution sectors and the hydrocarbons sector. Mr. García has represented sovereigns and private parties before the International Centre for Settlement of Investment Disputes (ICSID), International Centre for Dispute Resolution (ICDR) of the American Arbitration Association (AAA), International Trade Commission (USITC), U.S. Department of Commerce (USDOC), as well as in the US District Courts and in NAFTA proceedings.

Mr. García's international dispute resolution practice draws on his extensive experience in the areas of international law and foreign investment, privatizations, sovereign representation, work in the electricity and hydrocarbons sectors as well as his past international development experience working for UNICEF and as a Peace Corps volunteer in Costa Rica. Mr. García frequently speaks and presents at conferences and panel discussions on the subject of sovereign representation in international investment disputes.

Prior to joining Arnold & Porter, Mr. García practised law at Winston & Strawn LLP and White & Case LLP, counseled Vice Chairman Jennifer A. Hillman of the International Trade Commission ("ITC") in various trade matters before the ITC.

  • Representing and successfully defending the Republic of Ecuador and its state-run oil company Petroecuador on a request for a permanent stay of an AAA arbitration in the US Southern District Court of New York (on summary judgment).
  • Representing the Republic of Ecuador and its state-run oil company Petroecuador on the Circuit Court appeal of the US Southern District Court of New York's decision on summary judgment granting permanent stay of a AAA arbitration.
  • Representing a private Venezuelan hotel consortium in an ICDR arbitration against a major multinational hotel chain.
  • Representing Electricité de France (EDF) in two ICSID arbitration proceedings brought under bilateral investment treaties against a Latin American country.
  • Representing nine individuals of the Maya Achi communities from the Chixoy region of Guatemala against their own government over criminal charges brought about over a peaceful protest.
  • Representing the Republic of Chile in two ICSID arbitrations proceedings brought under bilateral investment treaties.
  • Successfully representing US importers in a Section 337 intellectual property dispute at the US International Trade Commission against a large multinational ball bearing producer.
  • Successfully representing an Argentine steel company in a countervailing duty investigation before the United States Department of Commerce.
  • Successfully representing various Latin American and several developing countries worldwide in a safeguard case before the International Trade Commission.
