Intellectual Property

Kristen Riemenschneider is an associate in Arnold & Porter LLP's intellectual property and government contracts practice groups, focusing on the broad range of legal issues facing technology companies, including federal government contractors. Ms. Riemenschneider is a registered patent attorney.

Her experience includes:

• assisting clients in developing global patent strategies and prosecuting utility and design patents in the software, electrical, and mechanical arts;
• drafting agreements for the commercialization of intellectual property and technology, including licensing, partnering and product development arrangements, service and development contracts, and federal subcontracts; and
• matters arising in connection with the intellectual property regime associated with federal government contracting, such as the role of data rights in federal procurements and the Bayh-Dole Act.

Ms. Riemenschneider joined Arnold & Porter following her clerkship for the Honorable Francis M. Allegra at the United States Court of Federal Claims. She is a 2006 graduate of the University of Virginia School of Law, where she served as a managing editor of the Virginia Journal of International Law and as an editor of the Virginia Journal of Law and Technology.

Prior to attending law school, Ms. Riemenschneider worked as an electrical engineer, researching and developing novel biometric authentication and personal security technologies.  Ms. Riemenschneider has significant experience with hardware and software development, and is particularly interested in cryptography, the protection of sensitive data, and the issues associated with the use of open source software.

Intellectual Property Representative Matters

• Advised a global pharmaceutical company in connection with the structuring and negotiation of numerous agreements with research institutions around the world.
• Provided structuring and diligence advice as intellectual property counsel in numerous multimillion dollar transactions (such as mergers, acquisitions, asset purchases and investments) with respect to target pharmaceutical companies, technology companies and government contractors.
• Assisted a US biotech company with a license and development agreement for an infectious disease product in Asia.
• Assisted a major research institution with patent prosecution and transactional matters.
• Assisted a major pharmaceutical company in a licensing and development transaction in Asia.
• Assisted a small business in a license and development transaction with a US university and oil-and-gas consortium.
• Counseled several major pharmaceutical companies with respect to the Bayh-Dole Act and waiver of the “substantial US manufacturing” requirement for technology developed with US Government funds.
• Assisted several US biotech companies with the negotiation of Cooperative Research and Development Agreements (CRADA) with the National Institutes of Health and the Department of Veterans Affairs.
• Assisted a major US company with the establishment of an endowment to be administered by the US Government.
• Counseled several small businesses on overall technology protection and commercialization strategy, including the management of intellectual property funded in whole or in part by the US Government.
• Assisted a foreign company with patent portfolio development and strategy in cryptography and related computer security subject matters.
• Managed a patent portfolio and patent strategy for a DoD contractor in electronics warfare applications.
• Counseled and represented US Government contractors in data rights disputes with various US Government agencies, including the US Army, US Navy and Defense Threat Reduction Agency.
• Counseled various entities with respect to licensing transactions of technology incorporating software licensed under various open source licenses, including the GNU Public License, the Mozilla Public License, the Apache License, and the BSD License.
• Represented a biotech company in a complex patent royalty arbitration.
