Practice Focus

Jessica Halbert is an associate in the intellectual property practice group, with a focus in trademark law. Her practice includes counseling and representing clients on matters of infringement, cybersquatting, and brand protection. Ms. Halbert has represented clients before numerous federal courts and the Trademark Trial and Appeal Board of the United States Patent and Trademark Office. She routinely counsels clients on trademark enforcement matters and on creating and executing action plans to target infringing actors, with particular attention to online infringement. Ms. Halbert's enforcement activities include written correspondence, coexistence agreements, and litigation. 

In 2007, Ms. Halbert was selected to represent Arnold & Porter LLP in the Loaned Associate Program for the Legal Aid Society of DC. For six months, Ms. Halbert provided full time pro bono service to Legal Aid in the area of housing law, where she represented numerous clients before the Superior Court of the District of Columbia and the Office of Fair Hearings, acting as lead counsel in administrative hearings, mediation, motions practice, brief and pleading drafting, and one-on-one client counseling regarding housing rights in the District of Columbia. Since returning to Arnold & Porter in 2008, Ms. Halbert maintains a strong pro bono litigation practice in the area of housing law.

Ms. Halbert graduated Order of the Coif from Vanderbilt University Law School in 2006, where she served as Chief Justice of the Vanderbilt Moot Court Board. 

Representative Matters

  • Served as second chair in trademark infringement and breach of contract matter in federal district court on behalf of a national sports organization, securing a consent judgment and payment of attorneys fees for the client at the mediation stage.
  • Represented a nationally-recognized philanthropist and his affiliated nonprofit organization in the negotiation and drafting of a coexistence agreement, maintaining client’s unilateral rights to a service mark in the areas of publication, media, educational, environmental, and social services.
  • Secured 23 infringing domain names registered by foreign party with a single action before the World Intellectual Property Organization for nationally recognized Voice over Internet Protocol (VoIP) service provider.

Pro Bono Matters

  • Represented client in administrative hearing, securing judgment in favor of client with full reinstatement into housing voucher program and an order of payment by government agency for all back rent due. Decision affirmed on appeal.
  • Represented tenants’ association before the Superior Court of the District of Columbia in preliminary injunction hearing based upon the Drug Nuisance Abatement Act, presenting oral argument and conducting direct examination of witnesses.
