Intellectual Property

Ian Kirby is a partner in Arnold & Porter's London office. He focuses on intellectual property disputes and multijurisdictional patent litigation, and he is head of the IP team in London. Ian is also a member of the WIPO List of Mediators.

Ian advises clients from a variety of industries, including the pharmaceutical, life sciences, engineering, software, microchip, telecommunications and media, and publishing industries. He also resolves disputes in all areas of IP law, with an emphasis on patent, copyright and software infringement, IP/antitrust disputes, comparative advertising, internet and domain name disputes, and trade marks and passing off/unfair competition disputes.

Ian has also advised multinational companies in connection with foreign corrupt practices laws and investigations, and has appeared in meetings before the US Department of Justice (DOJ) and UK Serious Fraud Office (SFO).

  • GSK v. Abbott Laboratories.  Acted for GlaxoSmithKline in a patent dispute with Abbott concerning monoclonal antibody technology.
  • Numatic v. Qualtex.  Represented Numatic, makers of the famous HENRY vacuum cleaners in its successful passing off claim against copiers Qualtex.
  • Baigent and Leigh v. Random House. Represented Random House and The Da Vinci Code author Dan Brown in a copyright case in which the claimants alleged that Brown had infringed copyright in their earlier work, The Holy Blood and The Holy Grail.
  • Rambus, Inc. v. Micron. Acted for Micron, a manufacturer of semiconductor memory products, in multi-jurisdictional litigation against Rambus Inc. involving patent and competition law claims and/or defences, and a parallel revocation action at the EPO.
