Antitrust/Competition
Ron Redcay’s extensive experience both as an outside litigator and as the head of a large inside legal group allows him effectively to represent a broad range of companies in antitrust litigation and counseling. He has won antitrust cases at all levels of both federal and state courts, and has extensive experience in defending antitrust class actions and State Attorney General lawsuits. He currently represents defendants in antitrust and unfair competition cases pending in several federal district courts and in California state courts, and provides counseling to a number of companies on cutting-edge antitrust issues.
Antitrust/Competition Representative Matters
Favorable results obtained:
- Dismissal for a major producer of Alaskan crude oil of an antitrust and unfair competition class action on behalf of all California gasoline purchasers. Defended that dismissal in the California Court of Appeal and Supreme Court.
- Dismissal for a refiner/marketer of gasoline of a class action on behalf of all California dealers alleging price-fixing, which was affirmed on appeal to the Ninth Circuit Court of Appeals.
- Dismissal for a large natural gas producer of an action alleging a conspiracy to raise gas prices by collusively refusing to deal with an entity that wanted to build a gas pipeline.
- Dismissal for a major pharmaceutical company of an antitrust and unfair competition case attacking contracts with pharmacy benefits managers and managed-care organizations.
- Dismissal for a major provider of cable television programming of an antitrust case attacking its distribution agreements. The dismissal was later affirmed by the Ninth Circuit Court of Appeals, with review denied by the US Supreme Court.
- Favorable settlements in antitrust class actions for companies in the pharmaceutical, chemical and computer memory industries.
