UK Enforcement & Dispute Resolution

Arnold & Porter's London Enforcement and Disputes Resolution practice is renowned for its handling of sophisticated and high-profile regulatory and economic crime cases.

The matters on which the firm is engaged arise in a wide range of factual scenarios across a multitude of industries including life sciences, financial services, defence, media and technology. The team advises on a variety of different projects ranging from contingency-orientated compliance programme review and implementation, to representation in investigations and litigious proceedings dealing with legal issues such as professional and financial regulation, workplace conduct, economic crime, and bribery and corruption. These engagements are often notable for their sensitivity, complexity and multi-jurisdictional nature.

Our team of lawyers includes barristers and solicitors with extensive experience across the full range of criminal and compliance work. Partners in the practice bring highly valued insight and expertise from time in Government and private practice, handling major investigations, prosecutions, Parliamentary Select Committee appearances and public inquiries.

We are frequently instructed, alongside our US team, by global companies to represent their interests in investigations conducted, for example: in the United Kingdom by the Serious Fraud Office (particularly under the Bribery Act 2010), Financial Conduct Authority, and Financial Reporting Council; in the United States by the Department of Justice and the Securities and Exchange Commission (under the Foreign Corrupt Practices Act); and across the European Union by the European Anti-Fraud Office. In addition, we advise regulated legal professionals in the United Kingdom on investigations and proceedings brought by the Solicitors Regulation Authority and Bar Standards Board.

We have extensive experience in advising corporate boards and senior executives in crisis management and reputational damage issues arising not only from investigations and enforcement actions, but also from reports of systemic workplace misconduct and whistleblowing.

The team's core expertise lies in:

  • conducting internal investigations;
  • advising on external law enforcement investigations;
  • reviewing, drafting, and implementing policies and procedures;
  • self-reporting and conducting matters with law enforcement agencies both in the UK and US on behalf of corporates; and
  • advising on reporting requirements under money laundering regulations.'
