Adoptive Couple v. Baby Girl, 133 S. Ct. 2552 (2013)
Our attorneys represented the petitioners at the certiorari and merits stages in this child custody dispute involving the federal Indian Child Welfare Act. The Court reversed the decision of the South Carolina Supreme Court and held that ICWA’s heightened procedural protections do not apply to a father who has never had custody of the child at issue. The Supreme Court victory led to an interstate battle on remand, where our team prevailed in the high courts of South Carolina and Oklahoma and defeated emergency relief sought in the U.S. Supreme Court. In September 2013, “Baby Girl” was reunited with her adoptive parents.
