City of Los Angeles v. County of Kern
Steven Mayer represented the County in Ninth Circuit appeal from District Court decision invalidating county initiative that prohibits land application of biosolids within the County. Case involves both Commerce Clause and state-law preemption claims. The court found that the plaintiffs had no prudential standing to challenge county ordinance under Commerce Clause. City of Los Angeles v. County of Kern, 581 F.3d 841 (9th Cir. 2009). After the Supreme Court denied certiorari, the federal district court dismissed plaintiffs' state law claims. The plaintiffs then refiled the case in state court, where it is still pending.
