Titanium dioxide antitrust class action litigation
Initially, the firm represented Cristal in a private class action brought by direct-purchaser plaintiffs alleging a price-fixing conspiracy among producers of titanium dioxide. Cristal USA reached a settlement with plaintiffs which received final approval from the court in December 2013. We also represented Cristal in a direct purchaser opt-out case (Valspar v. E.i. DuPont et al.) in the District of Minnesota. That matter settled in June 2016.
The firm also represents Cristal in an indirect purchaser class action alleging a price-fixing conspiracy among US producers of titanium dioxide, pending in the Northern District of California. We won our second Motion to Dismiss in August 2015 but lost, in part, a third Motion to Dismiss in May 2016. In July 2017, we submitted a motion for preliminary approval of a settlement for which the Court issued final approval in August 2018.
