Contaminated site litigation
Our attorneys currently represent a former chrome manufacturer in multiple litigations regarding over 150 different contaminated sites. In one of the litigations, before we were hired, our client was ordered by a federal court to undertake one of the largest and most complicated environmental excavations ever required—so large that it is expected to consume 25% of the Nation's hazardous waste disposal capacity over four years. We are representing the client before the federal court and the Special Master appointed to supervise the remediation. In separate litigations, we are defending the client against multiple RCRA citizen action suits and against the State's assertion of novel "market share" theories of liability for approximately 50 orphan sites. We have also participated in property redevelopment transactions with respect to several of these sites.
