Lucier v. SmithKline Beecham Corp., 724 F.3d 337 (3d Cir. 2013)
Our firm represented GlaxoSmithKline's US operating company and holding company in a dispute concerning the citizenship of those companies for purposes of federal diversity jurisdiction. The Third Circuit upheld GSK's position that under the separate rules governing citizenship of corporations and unincorporated associations, both GSK entities are citizens of Delaware for purposes of removing cases to federal court. As a result of the decision, numerous cases that GSK had removed will now remain in federal court.
