Investigation of the withholding of microprocessor information

Our attorneys helped Intel Corporation to settle a controversial Federal Trade Commission case involving a conflict between Intel's assertion of intellectual property rights and government antitrust enforcement policy. The FTC claimed that Intel had abused its alleged monopoly power by withholding information regarding the use of its microprocessors from customers who claimed that Intel was infringing their patents. This settlement which the National Law Journal referred to as "smart lawyering," was widely recognized as "win-win," because it protected Intel's basic IP concerns while avoiding time-consuming and adversarial litigation with an important government agency.
