Chowning v. Kohls Department Stores, Inc.
Our attorneys defended Kohl’s in a purported class action alleging false price comparison advertising in the Central District of California. The Court granted Kohl's motion for summary judgment as to the monetary claims brought under California's UCL, FAL, and CLRA. This was the first case to reject the "alternative" measures of restitution set forth in Spann v. JC Penney that authorized a full refund of the purchase price, among other things. The Ninth Circuit affirmed summary judgment.
