Our attorneys represented a mining company in the remediation of neighborhoods contaminated with tailings from one of the world's largest copper mines. At that site, we negotiated several consent orders with EPA which governed our client's remediation obligations, successfully defended a cost recovery action brought by the United States, and asserted and settled claims that the US government had Superfund liability. We also successfully defended and settled toxic tort litigation brought by the surrounding community which alleged property damage as well as personal injury from the lead, arsenic and cadmium found in the tailings.
