WPIX, Inc., et al. v. ivi, Inc.
Our attorneys represented thirteen of the major US TV programming content owners, broadcast networks, and broadcast station owners in a highly publicized copyright litigation on the unprecedented issue of whether a website (ivi.tv) can stream over the Internet broadcast television stations without the consent of the owners of programming on those stations, pursuant to the cable television compulsory license in Section 111 of the Copyright Act. The federal court in the Southern District of New York granted our clients a preliminary injunction and the Second Circuit affirmed. After the Supreme Court denied certiorari, ivi entered into a consent judgment including a permanent injunction.
