Coscarart v. Major League Baseball

Marty Glick and Dan Asimow represented Major League Baseball in class action litigation brought by a certified class of 350 retired former Major League Baseball players in Alameda County Superior Court for over US$100 million in damages alleging violation of the players’ right of publicity and breach of contract in connection with a Former Player Program initiated by Major League Baseball Properties. The jury rejected virtually all of plaintiffs’ claims, and ultimately the case was dismissed by plaintiffs for an agreement by Major League Baseball not to collect its costs.
