Our attorneys represented Oklahoma state officials in defending Oklahoma’s right to prevent a northern Texas water agency from diverting water located in Oklahoma back to Texas under the Red River Compact. The Supreme Court ruled unanimously that Oklahoma’s water statutes are neither preempted by the Compact nor prohibited by the Commerce Clause.  The Court’s decision protected key western water compacts that, like the Red River Compact, do not expressly authorize such cross-border diversions.
