People of the State of California v. PepsiCo, Inc., et al.
In People of the State of California v. PepsiCo, Inc., et al., our attorneys represented PepsiCo and its subsidiary Frito-Lay, the nation's largest snack food manufacturer, in Proposition 65 litigation brought by the California Attorney General and several private plaintiffs seeking warnings for the presence of the chemical acrylamide in potato chips. The case was initiated shortly after researchers discovered that acrylamide has always been present in many foods, including potato chips, crackers, cookies, cereal, and toast, as a result of the normal cooking process. After fact and expert discovery and hearings on four summary judgment motions, our client reached a favorable settlement on the eve of trial. We also represented our client in related regulatory proceedings.
