Garcia v. Wyeth-Ayerst Laboratories


After a three-week trial in Santa Fe District Court, a jury rendered a defense verdict for Wyeth in a diet-drug case brought by an Albuquerque woman in New Mexico's first diet drug trial. The plaintiff sought US$1 million in compensatory damages for open-heart surgery, plus punitive damages from Wyeth due to damage to her heart valve which she claimed was caused by the diet drug Redux. The jury determined that Wyeth was not negligent in the marketing and labeling of the diet drug and that the drug did not harm her.
