Smith v. Philip Morris Inc.
Our attorneys successfully resolved a 15-year-old price-fixing class action alleging the major tobacco companies had agreed to fix the wholesale price of cigarettes from 1993-2000. Of the 39 cases filed in state and federal courts across the country, this one had proceeded the longest without summary judgment being granted for defendants or voluntary dismissal by the plaintiffs. The case moved to summary judgment in October 2011, and in March 2012, the court granted the last win on behalf of our client, Philip Morris USA, and the whole defense group. In July 2014, the Kansas Court of Appeals affirmed the trial court's decision in its entirety in a unanimous opinion. In June 2015, the Kansas Supreme Court denied plaintiffs’ petition for review.
