PNY Technologies, Inc. v. Sandisk Corporation
Arnold & Porter represented PNY Technologies, Inc. in complex antitrust and contract litigation against SanDisk Corp. involving competitive practices in the USB flash drive and SD card markets and the terms and enforceability of a uniform patent license imposed on participants in the USB flash drive market. The firm was lead counsel in a six-week jury trial in California Superior Court in Santa Clara County in January through March 2014. At the conclusion of the trial, SanDisk was awarded damages, but in an amount considerably less than it claimed. Following substantial discovery and motion practice in the federal antitrust action (which challenged the validity of the license agreement), the parties entered into a full settlement of their dispute in August 2014.
