Our attorneys conducted a bench trial before Chief Judge Mukasey in the U.S. District Court for the Southern District of New York on behalf of Scott-Macon Securities, Inc. against Zoltek Companies, Inc.  Scott-Macon had sued Zoltek for warrants and placement fees due under an agreement between them. After trial, Judge Mukasey in April 2006 issued an opinion in favor of Scott-Macon awarding warrants having a current value in excess of $2.5 million and $3.5 million in placement fees, plus interest. On appeal, the U.S. Court of Appeals for the Second Circuit affirmed in large part, and remanded for determination of a narrow issue of the damages and warrants due on the final placement.
