US Airways

Our attorneys represented US Airways in its second restructuring under Chapter 11, addressing, among other things, complex labor litigation and aircraft finance issues, and culminating in a merger with America West Airlines. As lead restructuring counsel, attorneys from Arnold & Porter's Washington, DC, New York, and Denver offices represented US Airways on every aspect of the company's successful Chapter 11 restructuring, including negotiations with the Air Transportation Stabilization Board for continued financing during the Chapter 11 case; negotiations with aircraft lessors, including the treatment of leases under Section 1110 of the Bankruptcy Code; representing the company in seeking to modify collective bargaining agreements with four major unions and with respect to the modification of certain retiree benefits; negotiating with secured and unsecured creditors and vendors; working with governmental units and airport authorities with respect to airport leases; and obtaining bankruptcy court approval of a Chapter 11 plan that provided for US Airways' ultimate merger with America West.
