ATM Access Fee Litigation
Our attorneys represent Visa in connection with three class actions alleging that Visa and MasterCard ATM access fee rules violate various federal and state antitrust laws and state consumer protection laws, brought in the United States District Court for the District of Columbia. The cases are: Mackmin, et al. v. Visa Inc., et al., Stoumbos v. Visa Inc., et al., and National ATM Council, Inc., et al. v. Visa Inc., et al. The plaintiffs assert claims on behalf of nationwide classes of consumers and non-bank ATM operators. Defendants filed a motion to dismiss these actions, which was granted by the court in February 2013. The court later declined to alter the judgment or allow plaintiffs to amend their complaints, and plaintiffs have appealed to the United States Court of Appeals for the District of Columbia.
