May 6, 2015

New York: Eric N. Whitney has joined Kaye Scholer LLP as a Partner in the firm’s Litigation Department. Whitney’s practice emphasizes the representation of retail and investment banks, non-bank financial institutions, investment funds and managers, and securities issuers in a wide range of significant litigation, class-action and regulatory matters.

“Eric’s breadth of financial, government and class-action litigation experience further augments the firm's strong national Litigation Practice, a large part of which is focused on the financial services sector,” said Firm Managing Partner Michael Solow. “His proven talent and record for success will be an asset to our clients."

Whitney advises both companies and individuals in complex, high-stakes commercial litigation and arbitration matters, internal investigations and appellate proceedings involving corporate and asset-backed securities, commercial contracts, corporate governance and intellectual property, as well as in SEC, FINRA, CFPB and other regulatory investigations and actions. He has experience with disputes concerning corporate finance and asset backed securities transactions, consumer finance and banking, mortgage banking and servicing, credit cards, commercial real estate, patents, trade secrets and copyrights, antitrust and bankruptcy. Whitney has tried jury, non-jury and arbitration cases to decision and handled evidentiary and other hearings in state and federal courts throughout the country.

“Eric’s experience representing significant clients in a variety of cases before judges, juries and governmental bodies throughout the United States will both benefit our clients and help further expand the depth of our Litigation Practice,” said Vinny Sama, Partner and Co-Chair of the firm’s Litigation Department. “We’re pleased to add Eric to our growing group of talented litigators.”

Prior to joining Kaye Scholer, Whitney spent ten years in private practice at a New York City law firm. Previously, he was Senior Vice President and General Counsel to NextJet Technologies where he initiated and oversaw all of the company’s legal activities, including corporate governance, securities, regulatory compliance, litigation, commercial transactions, intellectual property and board matters. Before NextJet, Whitney was a litigator with Baker Botts LLP in both Dallas and New York City, as well as at Dallas litigation boutique Lynn Stodghill Melsheimer & Tillotson (n/k/a Lynn Tillotson Pinker & Cox, LLP).

“Kaye Scholer’s reputation for excellence, strong and long-standing New York presence and nationally recognized Litigation Practice offers me the platform necessary to best serve my client base and strengthen my practice,” Whitney said. “The firm’s tremendous experience within the financial services industry will provide unique benefits to my clients.”

Whitney earned his JD, cum laude, from Southern Methodist University Dedman School of Law, and his BA in Political Sciences from Duke University.
