Fair Lending Compliance:
Government’s Recent Enforcement Actions Reflect Expansive View of What Constitutes Lending Discrimination

On September 24, 2015, the US Department of Justice (DOJ) and the Bureau of Consumer Financial Protection (CFPB) released a consent order which, if approved by the court, would settle allegations that a depository institution violated the Equal Credit Opportunity Act and the Fair Housing Act by redlining certain majority-minority census tracts. The consent order is the latest in a series of actions taken by a number of regulators on both the state and federal level settling allegations of redlining based largely on statistical analysis rather than evidence of unequal treatment or denied loans.

The novel legal theories used by the DOJ and CFPB in the case continue to signal a major change in the way the law is being interpreted and applied. This change may require banks to rethink and reconfigure their fair lending compliance efforts to include additional loan origination; increased visibility through community outreach, including financial literacy programs; partnerships with community development and religious organizations; and establishing branch offices in majority-minority census tracts across a broader geographic footprint than existing CRA assessment areas.

We will be hosting a New York Regulatory Roundtable to discuss how the government’s new approach places mortgage lenders at risk. In addition, the panel will recommend strategies to mitigate the impact of this new enforcement approach.
