Dana (Dah-na) Kagan McGinley focuses her practice on white collar defense and investigations; appellate and Supreme Court matters; and U.S. sanctions and export control advisory work. As part of Dana’s appellate and Supreme Court practice, she has represented parties and amici at the certiorari and merits stages in the U.S. Supreme Court.
Dana maintains an active pro bono practice with a focus on appeals in criminal and civil rights cases, and Title VI work. Dana’s Title VI work is focused on representing the interests of Jewish students in campus antisemitism cases, both in internal grievance procedures and before the Department of Education’s Office for Civil Rights. Her involvement in campus antisemitism matters goes back to 2022.
Dana graduated magna cum laude from the Harvard Law School and summa cum laude from Dartmouth College, where she completed her undergraduate degree in Government with a focus on international relations. Before joining Arnold & Porter, Dana served as a law clerk to the Honorable Judith W. Rogers of the U.S. Court of Appeals for the D.C. Circuit and the Honorable Josephine L. Staton of the U.S. District Court for the Central District of California.

- Private citizen in a unanimous victory at the Supreme Court concerning application of the state-action doctrine to private social media use by public officials. Lindke v. Freed, 601 U.S. 187 (2024).
- Former correctional officer in a unanimous victory at the Supreme Court establishing that purely legal issues resolved at summary judgment are preserved for appellate review even in cases that go to trial. Dupree v. Younger, 598 U.S. 729 (2023).
- An individual in obtaining a non-prosecution agreement in a DOJ investigation related to violations of Russia sanctions.
- Major international aeronautics and space company in regularly advising on trade sanctions compliance and investigations, and drafting trade sanctions policies and procedures.
