The 21st Century Cures Initiative: Summary of the House Energy & Commerce Discussion Document and the Senate HELP Committee Chairman's Innovation for Healthier Americans Report

On January 27, 2015, House Energy and Commerce Committee Chairman Fred Upton (R-MI) released a massive "discussion document" seeking feedback on draft legislative provisions that, based upon stakeholder feedback, will ultimately form the 21st Century Cures Initiative legislation that will be introduced in the coming months.  The Initiative aims to "accelerate the discovery, development, and delivery of promising new treatments to patients."  Concurrently, the Chairman of the Senate Health, Education, Labor and Pensions (HELP) Committee released a report outlining ideas for legislation in this area and asking for public feedback.  Although it is unlikely the legislation outlined in these documents will be enacted in full, and opposition to some of the provisions has already emerged, it is clear that legislation focused on FDA and biomedical innovation will get serious consideration in this Congress.  This Advisory provides a summary of the House discussion document and Senate report.
