The Business Community Takes on the SEC: Who Will Win the Legal Battle over Dodd-Frank Disclosure Regulations?
In the past two months, business groups have filed a series of challenges in the D.C. Circuit attacking regulations promulgated by the SEC under the 2010 Dodd-Frank legislation. Among those regulations is the Conflict Minerals rule, which requires publicly traded companies to disclose whether their products contain certain minerals used to finance violent activities in central Africa. Also under attack are the Extractive Sector Transparency regulations requiring companies to report payments made to foreign governments to develop oil and gas fields and mining sites.
