The FDA's Upcoming Trans Fat Ban: Prelude to More Food Industry Litigation?
FDA has issued a Federal Register notice with a tentative determination that partially hydrogenated oils (PHOs) - the primary dietary source of trans fats - are no longer "generally recognized as safe," or GRAS, for any use in food. This webinar will assist food manufacturers, food retailers, and restaurants in preparing for potential new or expanded litigation should FDA issue its likely final decision to ban industrially-produced trans fats in foods.
Topics to be covered in the webinar will include:
- The basis for FDA's tentative determination of non-GRAS status for PHOs, potential next steps, and regulatory consequences
- Current plaintiff trans fats food class action litigation based on mislabeling and false advertising claims
- Preparing for and mitigating the risks of potential new and expanded claims in food industry litigation, including product liability claims
- Legal consequences of trans fat which occurs naturally in small amounts or is unavoidably produced during a food's manufacturing process
This is a webinar for in-house counsel.
