Restrictive Practices in Retailing and Distribution

LACBA Antitrust and Unfair Business Practices Section

This program will focus on distribution practices, including vertical price and non-price restraints. The panel will discuss recent developments in this highly active and dynamic area of the law, including the FTC’s February 2014 decision involving a “full support program” instituted by the nation’s largest iron pipe fittings supplier, McWane, Inc. The program will cover de facto exclusivity, loyalty discounts, and most favored purchaser agreements.
