Pompeo Quoted in Bloomberg Law on Boeing Co. Government Contract Lawsuit

Government Contracts and National Security partner Paul Pompeo was quoted in a Bloomberg Law article, “US Accounting Win Over Boeing Not ‘Bullet Proof,’ Attorney Says.” The story discusses the US Court of Federal Claims dismissal of a case between Boeing and the United States in which Boeing argues that the FAR provision applied by the government directly conflicts with the Cost Accounting Standards statute.

Pompeo stated that the decision was not “bullet proof” and that an appeal to the Federal Circuit would not be surprising, especially since the decision has flaws that could be remanded by the appeals court. Pompeo also pointed out that the current ruling is inconsistent with those previously made, making the likeliness of an appeal even higher.
