Former DOJ National Security Official Eun Young Choi Discusses Data Transfer Rule in Bloomberg Law
Eun Young Choi, White Collar Defense & Investigations partner and former Deputy Assistant Attorney General in the National Security Division (NSD) at the U.S. Department of Justice (DOJ), was quoted in the Bloomberg Law article, “Rule Protecting Sensitive Data From Foreign Threats Takes Force.” The piece examines the Justice Department’s implementation of Executive Order 14117, which imposes new restrictions on bulk transfers of sensitive personal and government-related data to countries deemed national security concerns, including China, Iran, and Russia.
Choi noted that the rule underscores national security concerns related to data transfers, including counterintelligence risks and artificial intelligence development. “It’s important to create rules of the road that companies can follow to ensure that they’re balancing the national security concerns against business considerations,” she said.
She also cautioned that companies should expect continued guidance and advisory opinions from the NSD. “There is going to be an effort from NSD to ensure that they are understanding what the pain points might be for companies and seeing what the path forward might be to provide clear guidance where there is ambiguity in the rule,” Choi said.
