Judah Prero Comments on Maine’s New PFAS Exemption Standards in Chemical Watch

Judah Prero, Environmental counsel and former Assistant State Attorney General at the Maryland Department of the Environment, was quoted in the Chemical Watch article, “Maine Regulators Set High Bar for First CUU Proposals Under PFAS Ban.” The article analyzes the impact of Maine’s “higher-than-expected” threshold for currently unavoidable use (CUU) exemptions under its per- and polyfluoroalkyl substances (PFAS) phase-out law.

Following the Maine Department of Environmental Protection’s rejection of nine CUU submissions, Prero cautioned that the state is taking a “hard line.”

“I would suggest to applicants that, in whatever degree they can, they truly highlight the essentiality of PFAS use in the product for the ‘health, safety and the functioning of society,’” he said. “Support that with more than just supposition — evidence or data should be provided.”
