Travis Annatoyn, Arnold & Porter Environmental counsel and former Deputy Solicitor for Energy and Mineral Resources at the U.S. Department of the Interior (DOI), was quoted in the Law360 article, “Feds Nix Large-Scale Enviro Review Of Nev. Solar Project,” which reported on the agency’s decision to cancel a programmatic National Environmental Policy Act (NEPA) review for a major solar development in Nevada.

Travis noted that while programmatic environmental reviews are often intended to streamline approvals, they can sometimes create additional complications for developers. He explained that in practice, developers sometimes endure both lengthy programmatic and project-specific reviews, and that such reviews can also invite multiple layers of litigation.

“However well-intentioned, sometimes these programmatic reviews can be a real albatross around a project’s neck,” he added.
