Corporate Counsel Quotes Brandon Neuschafer on California’s Ultra-Processed Foods Law
Arnold & Porter Consumer Products partner Brandon Neuschafer was recently quoted in the Corporate Counsel article, “New California Ultra-Processed Foods Law May Set Table for National Wave of Regulation,” discussing the potential implications of California’s new law banning ultra-processed foods from school lunches.
Brandon noted that the California law is broader and less clearly defined than those in other states, presenting complications for food companies that will need to determine their new compliance obligations or risk potential legal challenges.
“It’s not quite as clear as to what constitutes an ultra-processed food under California law, and it’s much more expansive,” he said. “[Companies] are going to have to better understand all the ingredients that they use and that they source from suppliers [and] really think hard” about whether their marketing claims are worth the risk of enforcement.
