Bloomberg TV Interviews Claire Reade on Supreme Court’s Recent Tariffs Ruling

Arnold & Porter senior counsel Claire Reade, former Assistant U.S. Trade Representative for China Affairs, appeared on Bloomberg TV to discuss the U.S. Supreme Court’s recent ruling on the International Emergency Economic Powers Act (IEEPA) and its implications for tariffs imposed by the Trump Administration.

Claire explained that the Court’s decision prevents the President from using IEEPA to impose tariffs but emphasized that other statutory options remain available. She observed that the Administration is likely to rely on alternative authorities that have previously withstood judicial scrutiny. “[The President is] revving the engine on some of his other tariff tools that have been tested in the courts that will not be overturned, like the tariffs he used in his first term against China,” Claire said. While these mechanisms require specific investigative processes, she added, “I have no doubt that they are going to use these tools.”

Claire also highlighted the broader trade implications, advising that “trading partners need to be on alert” for potential efforts to renegotiate existing arrangements to secure more favorable terms. She noted that countries such as Brazil and India will likely benefit from this ruling for the short term, while China “has a lot of tariffs on its goods that do not come from the statute that was overturned, so they all stay in place.”
