Law360 Interviews Lisa Re on CMS’ New Exclusion Authority

August 5, 2026

Lisa Re, Arnold & Porter Life Sciences & Healthcare Regulatory partner and former Assistant Inspector General for Legal Affairs at the U.S. Department of Health and Human Services (HHS) Office of Inspector General (OIG), was quoted in the recent Law360 article, “Lawyers Eye CMS’ New Power To Freeze Medicaid Funds,” discussing the implications of HHS expanding exclusion authority to the Centers for Medicare & Medicaid Services (CMS).

Because OIG has typically handled exclusion authority, Lisa emphasized that CMS’ new role could strengthen the government's healthcare fraud enforcement efforts.

“This is going to be a force multiplier,” she said.

She also noted that the expanded authority raises questions about how exclusion responsibilities will be divided between OIG and CMS, including whether the agencies will share authority or focus on different types of exclusions.

“It all depends on how they write it in the delegation,” Lisa said. “The devil’s in the details there.”
