Arnold & Porter Achieves Win-Win Settlement of Major EPA Enforcement Action

WASHINGTON, DC, October 5, 2015 -- On behalf of one of the world's largest fertilizer companies, The Mosaic Company, Arnold & Porter LLP recently negotiated a complex settlement with the US Environmental Protection Agency and the Department of Justice, as well as with the Florida Department of Environmental Protection and the Louisiana Department of Environmental Quality, to resolve allegations related to Mosaic's compliance with the Resource Conservation and Recovery Act (RCRA) at its phosphoric acid and ammoniated fertilizer manufacturing facilities in Florida and Louisiana. This widely reported settlement builds upon Mosaic's continued investments in improving its facilities to enhance environmental performance. 

The Arnold & Porter team was led by Les Sotsky, chair of the firm's Environmental practice, and Joel M. Gross, former chief of civil enforcement at DOJ's environmental section; other participating attorneys included Peggy Otum, Eric A. Rey, and Thomas E. Santoro.
