Malecek Speaks to Daily Journal on Patent Filing Trends
Partner and Co-Chair of Kaye Scholer’s IP Department, Michael Malecek, recently spoke with the Daily Journal regarding the number of new patent lawsuits for 2015, which broke four-year records this year when they spiked and then plunged—reflecting an increasingly volatile litigation market. Additionally, nearly half of the cases in the second quarter were filed in the Eastern District of Texas.
Malecek, who prevailed last month in the Eastern District of Texas on behalf of client Google, noted that if patent infringement cases were distributed evenly among the nearly 100 federal judicial districts in the United States, about 1 percent of patent lawsuits would be filed in each district.
He added, "It is absolutely mind-boggling that over 40 percent of the patent cases were filed in the Eastern District of Texas in the first half of 2015."
