Pharmaceutical Companies Face New State Marketing Disclosure Laws

Three states – Minnesota, Vermont and Maine – have enacted laws that require pharmaceutical manufacturers to report certain gifts and marketing expenditures to state regulatory bodies. The type of marketing activities covered and the reporting obligations imposed differ from state to state. In addition, more than a dozen other states are considering similar types of marketing disclosure laws. This memorandum summarizes the Maine, Vermont, and Minnesota laws and provides a brief overview of recent developments in other states.
