Who’s gonna win, legal department?
Hans-Joachim Fritz has published an article in BeraterMagazin, (headed „Quo vadis, Rechtsabteilung?“ - „who’s gonna win, legal department?”) dealing with the legal department as liability zone. The article focuses on the currently precarious situation of corporate lawyers’ and company representatives’ liabilities. Board members and CEOs are always one leg in jail when making management decisions. Corporate lawyers, esp. heads of legal departments, are supposed to evaluate any risks of liability beforehand and - therewith - support the management in their upcoming decision. So far, it has not yet been decided whether corporate lawyers have to bear the same liabilities as the CEOs and board members themselves regardless any legal priviledge of limitation of liabilities for senior staff.
