Who's Gonna Win—Legal Department?

Hans-Joachim Fritz has published this article in BeraterMagazin focusing on the legal department as liability zone. The article discuss the currently precarious situation of corporate lawyers' and company representatives' liabilities, as board members and CEOs always seem to have at least one leg in jail when making management decisions. Corporate lawyers, especially heads of legal departments, are supposed to evaluate any risks of liability beforehand to support management in their decision. So far, it has not yet been decided whether corporate lawyers have to bear the same liabilities as the CEOs and board members themselves regardless of any legal privilege of limitation of liabilities for senior staff.
