ESG: The Bottom Line

Brian Israel, chair of Arnold & Porter’s Environmental practice, discusses federal, state and international standards surrounding environmental marketing, particularly in relation to carbon offset claims. With the increasing desire to market goods and services as environmentally friendly, companies need to be mindful of compliance with applicable regulatory guidelines and best practices in relation to carbon offset or related “green” claims. Israel walks through the kinds of scrutiny that marketers can expect in the near future, as enforcement activity is expected to rise and the Biden Administration intends to refresh the FTC’s Green Guides.
