Pension and Welfare Plan Counseling

Our benefits attorneys have broad experience in the area of pension and welfare plans. We counsel employers on establishing and maintaining compliance for a wide range of pension and welfare plans, including defined benefit, cash balance, 401(k), and employee stock ownership plans; 403(b), 457(b), and 457(f) plans; and health, welfare, and cafeteria plans. We advise clients on plan qualification issues; controlled group liability; correction of plan errors through IRS and Department of Labor (DOL) self-correction programs; drafting and negotiation of trust, investment advisory, and administrative services agreements; pension and welfare plan aspects of mergers and acquisitions; plan termination and underfunding issues; benefits-related dispute resolution; and employer share responsibility obligations under the Affordable Care Act. Our attorneys regularly represent clients before the IRS and the DOL with respect to pension and welfare plans, including the filing of determination letter applications and voluntary compliance program (VCP) submissions with the IRS, and plan audits.
