The SFO and DOJ's "Special Relationship": The Future of UK/US Co-Operation Against Overseas Corruption and Other Crimes
Richard Alderman, Director of the Serious Fraud Office (SFO), will be joined by Arnold & Porter partners John Bellinger III, former Legal Adviser to the US Department of State under former Secretary of State Condoleezza Rice, and Marcus Asner, former Chief of the Major Crimes Unit for the US Attorney's Office for the Southern District of New York, for an engaging panel discussion on the new direction of the SFO.
The SFO and the US Department of Justice (DODOJ) are working increasingly close to investigate and prosecute overseas corruption involving British and American businesses. Co-operation includes conducting joint investigations and the sharing of evidence and potential extradition under the new US-UK Extradition Treaty. The SFO recently announced US-style self-reporting guidelines and has demonstrated a vigorous approach to attacking bribery cases. In addition, the UK is considering adopting a US-style prosecution model, complete with plea bargaining and credit for compliance. In the US, both the DODOJ and the Securities and Exchange Commission are ramping up enforcement of the Foreign Corrupt Practices Act (FCPA) against both US and foreign companies.
