Investment Firms Should Revisit Development Strategies Amidst Treasury Department’s Proposal on Foreign Investment

White Collar Defense & Investigations partner Deborah Curtis was quoted in the recent Foreign Investment Watch article, "Experts say outbound rule could impact investments in the U.S." The article discusses the U.S. Treasury Department’s proposal on outbound foreign investments, which seeks to ban transactions involving technologies and products that might threaten national security. The proposal follows the Biden Administration’s executive order restricting investments in Chinese technologies.

Although the proposed rule largely focuses on investments in China, experts say it could also apply to investments in other countries. Curtis told Foreign Investment Watch that investment firms should aim to “recalibrate investment development strategies now” by examining interconnections among investments and by keeping a record of the “‘who’ and ‘what’ involved in investment and partnering opportunities.”
